TERMS OF SERVICE
Welcome to Figix LLC. By accessing our website, uploading documents, or using our data extraction services (collectively, the “Services”), you agree to be bound by these Terms.
If you do not agree, do not use our Services.
1. NATURE OF SERVICE:
Figix LLC provides document processing, data extraction, and
workflow automation services for small businesses, including
CPAs, contractors, manufacturers, and other business professionals.
We use a combination of Artificial Intelligence (AI) and human review to convert unstructured documents (receipts, invoices, statements) into structured data formats (Excel, CSV, JSON, etc).
2. NO FINANCIAL OR ACCOUNTING ADVICE
The “Verification” Clause: The spreadsheets and data outputs provided by Figix are for administrative support purposes only.
- We are not CPAs: Figix LLC is a technology provider, not a public accounting firm, tax advisor, or financial planner.
- Your Responsibility: You acknowledge that you (the Client) are solely responsible for reviewing, verifying, and reconciling all data provided by Figix before using it for tax filings, financial statements, or audits.
- Liability: We are not liable for any tax penalties, interest, audit findings, or financial losses resulting from errors in the data we extract.
3. BETA SERVICES & FREE TRIALS If you are using our services as part of a “Free Test Run,” “Beta,” or “Pilot Program”:
- As-Is Basis: Services are provided “as-is” without warranty of any kind.
- Feedback: You agree to provide reasonable feedback regarding the accuracy and utility of the output.
- Termination: We reserve the right to end a free pilot or beta program at any time.
4. THIRD-PARTY DEPENDENCIES
Our service relies on secure third-party AI (e.g., OpenAI) to process text.
- Service Availability: We are not responsible if a third-party provider experiences downtime that delays the delivery of your data.
- Accuracy: While we utilize top-tier AI models, we do not guarantee 100% accuracy on handwriting or low-quality images.
DATA SECURITY & PRIVACY - Encryption: Files are transmitted using secure protocols (such as SSL/TLS) where supported by the transmission method used.
- Storage: Documents may be transmitted to us via secure email or third-party file-sharing services (e.g., Dropbox). Files are stored only as long as necessary to complete processing and client review and are typically deleted within 30 days unless you request otherwise.
- Access: Only authorized Figix LLC personnel have access to your data, solely for the purpose of document processing and quality assurance.
- Third-Party Processing: We use third-party AI processing providers (e.g., OpenAI) to extract data from documents. Client data is processed only to deliver the requested services and is not used to train AI models. Processing is subject to the third party’s applicable privacy and security policies.
- No Selling of Data: We do not sell, rent, or share your financial data with third parties for advertising or marketing purposes.
5. CLIENT RESPONSIBILITIES
You agree that:
- Authorization: You have obtained all necessary permissions from your clients to share their financial documents with us for processing.
- Data Hygiene: You will not upload illegal content or documents unrelated to financial record-keeping.
- Confidentiality: You will keep any pricing or proprietary workflow details provided by Figix confidential.
INDEMNIFICATION
You agree to indemnify and hold harmless Figix LLC, its officers, employees, and contractors from third-party claims, damages, or expenses (including reasonable attorneys’ fees) arising from: - Your violation of these Terms or the Privacy Policy
- Your failure to obtain required permissions or client consent
before submitting documents - Your submission of unlawful, infringing, or fraudulent content
- Your use of the Services in a manner not permitted by these Terms
- Your reliance on extracted data without appropriate review and
verification as required under these Terms
6. PAYMENT & CANCELLATION
- Invoicing: For paid services, invoices are due upon receipt unless otherwise agreed in writing.
- Refunds: Due to the labor and computing costs involved in processing data, payments are non-refundable once the data processing has begun. If processing has not yet started, a refund or credit may be issued at Figix LLC’s discretion.
7. INTELLECTUAL PROPERTY
Our Technology:
Figix LLC retains all right, title, and interest in and to the
underlying software, scripts, automation workflows, processes, and
proprietary templates used to provide the Services.
Client Data:
You retain full ownership of the documents you upload and the
specific financial data extracted from them. Figix LLC does not
claim ownership over your data and uses it solely to provide the
Services.
8. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW:
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Figix LLC shall not be liable
for any indirect, incidental, special, or consequential damages,
including loss of revenue, loss of profits, loss of data, or business
interruption, arising out of or related to the Services.
Cap on Liability:
Figix LLC’s total cumulative liability for any claims arising out of
or related to this agreement shall be limited to the total amount
paid by you to Figix LLC in the three (3) months preceding the event
giving rise to the claim. If the Services were provided free of
charge or as part of a beta or pilot program, liability shall be
limited to $100 USD.
9. TERMINATION
We may suspend or terminate your access to the Services immediately
if you materially violate these Terms. We may also discontinue the
Services upon reasonable notice.
Upon termination, we will cease processing your data and, upon
request, delete any remaining client documents in accordance with
our data retention policies.
10. GOVERNING LAW
These Terms shall be governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in the courts located in Georgia.
