TERMS OF SERVICE
Welcome to Figix LLC. By accessing our website, using our dashboards, or purchasing our services (collectively, the “Services”), you agree to be bound by these Terms.
If you do not agree, do not use our Services.
1. NATURE OF SERVICE
Figix LLC provides data aggregation, reporting automation, and analytics dashboards for businesses. We are a technology provider, not a financial advisor or advertising agency.
- We do not manage your ad spend.
- We do not guarantee specific marketing results (e.g., ROAS or Profit).
- We provide visibility into your data as it exists on third-party platforms.
2. NO FINANCIAL OR LEGAL ADVICE
The “Use at Your Own Risk” Clause: The data, charts, and alerts provided by Figix are for informational purposes only. While we strive for accuracy, automated systems can experience errors (“hallucinations,” API sync delays, or calculation glitches).
- You acknowledge that: You will independently verify all data before making critical financial decisions (such as scaling ad budget or firing employees).
- We are not liable: For any financial loss, lost profits, or business interruptions resulting from decisions made based on our dashboards.
3. THIRD-PARTY DEPENDENCIES
Our service relies on APIs provided by Meta (Facebook), Google, TikTok, Stripe, and others.
- Platform Changes: We are not responsible if a third-party platform changes their API, revokes access, or experiences downtime.
- Downtime: If a third-party API (e.g., Facebook) goes down, your dashboard may stop updating. This is out of our control and does not constitute a breach of contract by Figix LLC.
4. CLIENT RESPONSIBILITIES
You agree that:
- Authorization: You have the legal right to grant us access to the ad accounts and financial accounts you connect to our system.
- Security: You will keep your login credentials confidential.
- Fair Use: You will not attempt to reverse-engineer our code or resell our dashboards as your own proprietary software.
5. PAYMENT & CANCELLATION
- Subscription: Services are billed on a recurring monthly basis.
- No Refunds: Payments are non-refundable, even if you do not use the dashboard during the month.
- Cancellation: You may cancel at any time via email to support@figixllc.com. Access will continue until the end of your current billing cycle.
6. INTELLECTUAL PROPERTY
- Our Code: Figix LLC owns all rights to the underlying code, scripts, dashboard templates, and automation logic.
- Your Data: You retain full ownership of your proprietary business data (e.g., your specific ad spend numbers and client lists).
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW: In no event shall Figix LLC be liable for any indirect, incidental, special, or consequential damages, including loss of revenue, loss of data, or loss of clients.
Cap on Liability: Our total cumulative liability to you for any claims arising out of this agreement shall be strictly limited to the amount you paid us in the 3 months preceding the claim.
8. TERMINATION
We reserve the right to terminate your account immediately, without notice, if you:
- Violate these Terms.
- Abuse our staff or support channels.
- Attempt to hack or compromise our systems.
9. GOVERNING LAW
These Terms shall be governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in the courts located in Georgia.
